Terms of Service

These Terms govern your access to and use of Murmly's desktop application, websites, and related services (the "Services"), provided by Murmly Inc. ("Murmly", "we", "us"). By creating an account or using the Services, you agree to these Terms.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You're responsible for the activity under your account and for keeping your credentials secure. Notify us promptly at security@murmly.io if you suspect unauthorized access.

You must provide accurate information when registering, and complete email verification and two-factor authentication where required.

2. The Services

Murmly is a voice-first work tool that transcribes your speech and, on your instruction, performs actions across third-party applications you connect (such as email, calendar, messaging, and document tools). You authorize Murmly to act on your behalf within the scope of the commands you issue.

You remain responsible for the actions you instruct Murmly to take. Mutating actions provide a short undo window, and higher-risk actions request confirmation, but you should review previews before confirming.

3. Plans, trials & billing

Murmly offers a Free plan and paid plans (e.g. Pro and Team). New accounts may include a time-limited Pro trial; when a trial ends without an active paid subscription, the account moves to the Free plan. Nothing is deleted in this transition.

Paid plans renew automatically each billing period until cancelled. You can cancel at any time; access continues until the end of the current period. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.

4. Acceptable use

You agree not to misuse the Services. In particular, you will not: (a) break the law or infringe others' rights; (b) attempt to access accounts or data that aren't yours; (c) probe, scan, or circumvent our security or rate limits except under an authorized security test; (d) resell or abuse the Services in a way that degrades them for others; or (e) use the Services to send spam or unlawful content.

5. Third-party integrations

When you connect a third-party service, your use of that service remains subject to its own terms. We act only within the permissions you grant and the commands you issue. We aren't responsible for third-party services, and they may change or revoke access at any time.

6. Privacy

Our handling of your data is described in the Privacy Center and Security Overview. In short: local-first by default, cloud calls are opt-in and audited, and we minimize what we retain. By using the Services you consent to that processing.

7. Intellectual property

The Services, including software, design, and trademarks, are owned by Murmly and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services per these Terms. You retain ownership of the content you create; you grant us only the limited rights needed to operate the Services for you.

8. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We don't warrant that the Services will be uninterrupted, error-free, or that automated actions will always interpret your intent perfectly. Always review previews for important actions.

9. Limitation of liability

To the maximum extent permitted by law, Murmly will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Services in a way that creates risk or legal exposure. On termination, the rights granted to you end; sections that by their nature should survive will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll provide reasonable notice (for example, by email or in-app). Continued use after changes take effect means you accept the updated Terms.
